Terms and conditions governing the purchase, licensing, and use of Foulware gaming software, DMA custom firmware, and digital products.
Important Notice: By purchasing, accessing, downloading, or running any Foulware software, hardware macros, or DMA firmware, you agree to be bound by these Terms of Service. Please read them carefully before making any purchase.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "You") and Foulware ("Foulware", "we", "us", or "our"). These Terms govern your access to and use of our website (foulware.com), digital licenses, software loaders, DMA (Direct Memory Access) firmware, macros, and related services (collectively, the "Services").
If you do not agree to all terms and conditions stated herein, you must immediately cease accessing our website and refrain from purchasing or using our Services.
2. License Grant & Permitted Use
Subject to your continuous compliance with these Terms and payment of applicable licensing fees, Foulware grants you a limited, non-exclusive, non-transferable, revocable license to use our software for personal, non-commercial entertainment purposes.
License Restrictions
You agree that you will not, directly or indirectly:
- Reverse Engineer: Decompile, disassemble, trace, debug, dump, analyze, or reverse engineer any Foulware binary, loader, kernel driver, or DMA firmware.
- Redistribute & Share: Distribute, lease, lend, sublicense, sell, or transfer your license key, loader access, or account to any third party.
- Circumvent Protections: Bypass, modify, disable, or tamper with our authentication mechanisms, HWID lock validation, or anti-tamper safeguards.
- Public Leakage: Upload, publish, or publicly share proprietary firmware binaries, configuration files, or license credentials on forums, file hosts, or repositories.
Violation Consequences: Any detected attempt to reverse engineer, dump memory, crack, or share license keys will result in immediate and permanent license revocation, HWID blacklisting, and a ban from the Foulware ecosystem without refund.
3. DMA Firmware & Hardware Policy
Foulware provides custom 1:1 DMA firmware tailored to individual Direct Memory Access hardware boards (e.g., PCIe Squirrel, Enigma, LeetDMA, CaptainDMA, and compatible devices).
- Hardware Responsibility: You are responsible for ensuring that you possess compatible hardware (DMA board, secondary PC, fuser, KMBox/USB host controller) and compatible firmware flashing tools.
- 1:1 Custom Device Generation: Custom 1:1 firmware builds are generated specifically for your chosen donor device parameters. Due to the bespoke compilation process, custom firmware builds are uniquely bound to your order.
- Flashing & Operational Safety: Flashing firmware carries inherent hardware-level risks if instructions are not followed. Foulware provides detailed guides, but we cannot be held liable for bricked hardware resulting from user error, incompatible cables, power outages, or improper third-party JTAG/FTDI flashing tools.
4. Digital Goods & Refund Policy
All products sold by Foulware are intangible, non-tangible digital goods (software license keys, downloadable macro configurations, and bespoke firmware binaries).
Strict No-Refund Policy
- Immediate Delivery: Upon purchase confirmation, license keys and download links are delivered immediately to your account dashboard and email. Because digital keys cannot be reclaimed once revealed, all sales are final and non-refundable.
- Game Updates & Maintenance: Online competitive games release frequent updates. Foulware commits to delivering rapid compatibility patches, but temporary downtime for maintenance or patch updates does not qualify for a refund.
- Compatibility Confirmation: It is the buyer's sole responsibility to verify system requirements (e.g., Windows version, virtualization settings, motherboard PCIe configuration) prior to purchasing.
Support & Dispute Resolution
If you encounter technical issues with your purchase, our support team is available 24/7 via Discord ticket to assist you with installation, configuration, or HWID reset requests. Opening a payment dispute or fraudulent chargeback without contacting support first will result in immediate account termination and permanent blacklisting across partner networks.
5. Third-Party Games & Anti-Cheat Disclaimer
Foulware develops cutting-edge enhancements and DMA bypass solutions designed with maximum stealth, stream-safety, and hardware isolation. However, you acknowledge and agree to the following:
- Third-Party Terms: Using third-party software or gameplay enhancements may breach the Terms of Service, End User License Agreements (EULA), or Codes of Conduct of specific game publishers (e.g., Valve, Riot Games, Krafton, Activision, BattlEye, Easy Anti-Cheat, Vanguard).
- Inherent Risks: Although Foulware utilizes advanced ring-0 and DMA isolation techniques, no software in the competitive gaming industry can guarantee 100% eternal immunity from future game anti-cheat heuristic updates or manual reviewer bans.
- Assumption of Risk: You assume all risk and responsibility for the use of Foulware on your personal accounts. Foulware is not liable for account suspensions, in-game penalties, ranks, or inventory losses resulting from gameplay.
6. Accounts, Billing, and Subscriptions
- Account Integrity: You are solely responsible for maintaining the confidentiality of your login credentials, OTP codes, and license keys.
- Recurring Subscriptions: If you purchase a recurring subscription plan (e.g., monthly access), your payment method will be billed automatically at the start of each billing cycle until cancelled. You may cancel your subscription at any time via the User Dashboard or customer billing portal.
- Price Adjustments: Foulware reserves the right to modify pricing, subscription tiers, or product availability at any time with prior notice.
7. Disclaimer of Warranties
THE SERVICES, SOFTWARE, AND FIRMWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Foulware does not warrant that:
- The Services will always be uninterrupted, error-free, or entirely bug-free.
- Third-party games will not alter their anti-cheat detection methods or game memory structures.
- Defects or incompatibilities with non-standard hardware setups will be remediated immediately.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOULWARE, ITS DEVELOPERS, EMPLOYEES, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GOODWILL, HARDWARE DAMAGE, SYSTEM CRASHES, OR IN-GAME SUSPENSIONS, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SERVICES.
In any scenario, Foulware’s total aggregate liability shall not exceed the amount actually paid by you for the specific product or subscription during the thirty (30) days preceding the event giving rise to liability.
9. Modifications to Terms
We reserve the right to revise or modify these Terms at any time. When modifications occur, we will update the "Last Updated" date at the top of this document. Continued use of our Services following any modifications constitutes your explicit acceptance of the revised Terms.
10. Community Conduct & Inquiries
We foster a respectful, professional gaming community. Disruptive behavior, harassment of support agents, spreading malicious links, or attempting to trade unverified keys within our official channels will result in immediate removal from our community.
